Terms of Business

Commencement of Instruction

  1. Interviewing, acceptance and subsequent engagement and re-employment of a nanny by you (‘the Client”) through Jennifer Lawrence (“the Agency”) constitutes the acceptance of these terms and conditions.
  2. Introductions are confidential. The passing of an introduction to another employer which results in an engagement, renders the Client to payment of the Agency’s fees.

 

Fees

  1. All fees whether for temporary or permanent placements are charged at 8.5% of the agreed annual salary (pro-rata where applicable)
  2. Invoices should be paid within seven days from date of invoice. Accounts unsettled within this period will accrue interest of 10% per week.
  3. Where a temporary nanny is taken on for more than 5 months the fee is based on a full year’s salary basis.

 

Refunds – Permanent Placements Only

Provided the invoice is paid in full within seven working days in the event of a nanny being deemed unsuitable by the client within a period of six weeks, ever endeavour will be made to find a suitable replacement. If this is not possible within four weeks, the following will apply:
  • First week - full refund less 10%
  • Second week - full refund less 12%
  • Third week - full refund less 15%
  • Fourth week - full refund less 20%
  • Fifth week - full refund less 25%
  • Sixth week - full refund less 30%
The refund terms shall not apply if:

  1. Nanny has left as a result of unreasonable conditions or conditions different from those stated in the job description given to the Agency by the Client in the first instance.
  2. The Agency is not informed in writing by the Client within 48 hours setting out full reasons for the termination.
  3. Should the Client have not settled the account within the required seven days they will be liable for the full amount.
  4. A replacement has been found within a period of four weeks through the Agency
  5. If the nanny is cancelled for any reason before commencement of duties 50% of the nanny’s first week’s salary will become due as well as 50% of the Agency fees.

 

Wages and Time-Off

  1. Wages and time-off, exact duties and all other terms of employment should be negotiated and agreed before commencement of employment. When agreeing wages both parties should be clear whether the wages are quoted gross or nett.
  2. The Client is solely responsible for the nanny’s National Insurance and PAYE contributions. If you employ a nanny within the UK you may be required by law to register straightaway as an employer within the Inland Revenue and operate a PAYE (Pay As You Earn) scheme. We can provide details of organisations who can help you with this.

 

Liability

  1. The Agency agrees to make every reasonable effort to ensure the suitability of nanny’s on behalf of the Client, but cannot accept responsibility for any loss, expense, damage or delay, however caused.
  2. The Agency, its employees and its agents cannot accept responsibility for loss or damage arising out of any introduction, nor do they give any warranty concerning the history, character, age, capability or suitability of any staff.
  3. Clients are strongly advised to check references even though the Agency will have already done so.
